Terms of Service

1. Acceptance of Terms

By accessing or using GmailHamster.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Farluner Apps, ul. Dominikańska 21B, 02-738 Warsaw, Poland ("we", "us", "our").

2. Description of Service

GmailHamster.com is a web application that connects to your Gmail account via Google OAuth 2.0 and compresses email attachment files (images, PDFs, videos) in-place, reducing the storage space they consume in your Google account.

The Service operates as follows:

1. You authorise the Service to access your Gmail account via Google OAuth.
2. You select emails whose attachments you wish to compress.
3. Attachments are temporarily downloaded to our servers, compressed, and returned to Gmail.
4. The original email is moved to Gmail Trash; a new email with the compressed attachment replaces it, preserving all labels and thread position.
5. Temporary files are deleted from our servers immediately after processing.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Service.
• You must have a valid Google account and agree to Google's Terms of Service.
• The Service is not available in jurisdictions where it is prohibited by law.
• If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

4. Account & Google OAuth Authorization

Access to the Service requires authenticating via Google OAuth 2.0. By authorising the Service, you grant us permission to:

• Read the list of your emails that contain attachments.
• Download selected attachment files for compression.
• Create a new email with the compressed attachment and move the original to Trash.

We will never access your Gmail beyond what is necessary to perform the compression workflow you initiate. You may revoke access at any time through your Google Account settings or via your GmailHamster.com account page.

You are responsible for maintaining the security of your Google account. We are not liable for any loss resulting from unauthorised access to your Google account.

5. Payment & Access

The Service is offered on a one-time payment basis — there is no recurring subscription. Upon successful payment, you receive access to the Service for the period or usage quota associated with the plan you purchased.

• Payments are processed securely by Stripe, Inc. We do not store your payment card details.
• All prices are displayed inclusive of any applicable taxes.
• Refunds: You may request a refund within 14 days of purchase if you have not used the Service to compress any attachments. To request a refund, email farluner.privacy@gmail.com.
• We reserve the right to change pricing for future purchases. Existing paid access is not affected by price changes.

6. Acceptable Use & Prohibited Conduct

You agree to use the Service only for its intended purpose. You must not:

• Use the Service to access Gmail accounts you do not own or are not authorised to access.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Use automated scripts, bots, or tools to interact with the Service outside of the provided interface.
• Attempt to circumvent any security measures, rate limits, or access controls.
• Use the Service in a way that violates any applicable law or regulation, including Google's API Terms of Service and Gmail Program Policies.
• Resell or sublicense access to the Service without written permission.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.

Violation of these rules may result in immediate termination of your access without refund.

7. Gmail Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key commitments regarding your Gmail data:

• Attachment files are processed temporarily and deleted from our servers immediately after compression — maximum 24 hours.
• We do not read, store, or analyse the text content or subject lines of your emails.
• We do not use your Gmail data to train AI or machine-learning models.
• We do not share your Gmail data with third parties except as described in the Privacy Policy.
• Our use of Gmail data complies with the Google API Services User Data Policy, including the Limited Use requirements.

8. Intellectual Property

All content, code, design, and branding of GmailHamster.com are the exclusive property of Farluner Apps and are protected by applicable intellectual property laws.

Your Gmail data and attachments remain your property at all times. We claim no ownership over any files you process through the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

• We do not guarantee that the Service will be uninterrupted, error-free, or free from data loss.
• Compression is lossy for images and videos — quality is reduced by design. Always review the preview before accepting.
• The original email is moved to Gmail Trash after compression. It remains recoverable for up to 30 days unless you empty Trash manually. After Gmail permanently deletes it, the change is irreversible.
• We are not affiliated with, endorsed by, or sponsored by Google LLC.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Farluner Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of emails, or loss of Gmail storage.

Our total liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, as required by Polish and EU consumer protection law.

11. Termination

You may stop using the Service at any time and revoke OAuth access from your Google Account settings. To delete your account and associated data, email farluner.privacy@gmail.com.

We reserve the right to suspend or terminate your access immediately and without refund if you violate these Terms, abuse the Service, or engage in fraudulent activity.

Upon termination, your right to use the Service ceases. Sections 7, 8, 9, 10, and 13 survive termination.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the new Terms take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

The "Last updated" date at the top of this page always reflects the current version.

13. Governing Law & Disputes

These Terms are governed by the laws of Poland and, where applicable, the laws of the European Union (including GDPR and EU consumer protection directives).

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Warsaw, Poland.
